Welcome to the December 2024 edition of our Malaadhu Thar’wah newsletter. In this edition, we will continue with our case studies on multi-generational wealth planning for a family.
The Client
Hajia Jemila Uthman is a thriving textile trader living in Ilorin, Nigeria. She has accumulated significant savings over the years and wants to distribute some of her wealth to her adopted children (people working for her) and charitable causes during her lifetime. Hajia Uthman wants to ensure that her gift-giving aligns with Islamic principles.
The Challenge
Hajia wants to make Hibah (gifts) to her adopted children, and a local Islamic school but she is unsure about the provisions of Shariah and the potential impact it could have on her children’s future inheritance.
The Solution
Hajia consults with an Islamic estate planning expert who advises her on the following:
- She can make Hibah if the gifts do not exceed one-third of her total wealth.
- The Hibah should not be given to someone already entitled to a share under the Faraid (Islamic inheritance) rules, as this could be considered a violation of the Shariah.
- Hajia can make Hibah to the local Islamic school, as this would be considered a charitable contribution and would not affect her children’s inheritance.
- Hajia documents all her Hibah transactions and ensures that her children are aware of the gifts, to avoid any potential disputes in the future.
The Outcome
Hajia can distribute her wealth during her lifetime in a manner that aligns with Islamic principles. Her Hibah to her family members and the local Islamic school are well-received, and her children understand the rationale behind her gift-giving decisions.
